Terms of Service

These terms are an agreement between you and LevelUpX Solutions (“we”) covering TCG Command Center (“TCC”), including the website, the app, our Discord integration and any connected point of sale tools. By creating an account or using TCC you agree to them. If you do not agree, do not use the service.

1. Your account

• You must be at least 13 to hold an account. Webcam play and other live surfaces require you to be 18 or older.
• Give accurate information and keep it current.
• You are responsible for what happens under your account. Use a strong password, and turn on two factor authentication.
• One person per account. Do not share logins or resell access.
• Tell us promptly at support@tcgcommandcenter.com if you think your account has been compromised.

2. Plans, credits and billing

• Paid plans renew automatically until you cancel. You can cancel at any time and keep access to the end of the period you already paid for.
• Credits are a usage allowance, not money. They have no cash value, cannot be transferred or redeemed, and are not refundable. Promotional or gifted credits may carry their own expiry.
• Plan allowances, credit rates and prices can change. We will tell you before a change affects a renewal.
• Fees are non refundable except where the law requires otherwise. If something goes genuinely wrong on our side, contact us and we will make it right.
• Payments run through Stripe and are also subject to Stripe’s terms.

3. Pricing information is an estimate

TCC aggregates prices from third party sources including TCGplayer and PriceCharting. Those figures are estimates of what cards have sold for. They are not appraisals, not offers to buy or sell, and not financial or investment advice.

Do not rely on TCC valuations for insurance, tax, lending, estate or resale decisions without independent verification. Prices move, sources disagree, and mapping a physical card to a priced product is imperfect. We make no guarantee that any figure is accurate, current or complete.

4. Card identification is not guaranteed

Scanning uses automated image recognition. It is good, and it is not perfect. It can misread a card, pick the wrong printing, or confuse visually similar variants.

Check what the scanner produced before you sell, ship, price or insure anything. You are responsible for the accuracy of your own listings and inventory. We are not liable for losses caused by a misidentified card.

5. Trades and sales between users

TCC helps you find people and see what overlaps between your collections. When you actually trade or sell, that deal is between you and the other person. We are not a party to it.

• We do not escrow, guarantee, insure or arbitrate trades.
• We do not verify that anyone owns, or will send, what they say they will.
• Reputation signals such as completed trade counts are informational only and can be gamed. Use your own judgement.
• Meeting in person is at your own risk. Meet somewhere public.

6. Acceptable use

Do not:

• Break the law, infringe intellectual property, or help anyone else do either.
• Harass, threaten, or abuse other users, or expose anyone to sexual content, especially during webcam play.
• Record another player without their knowledge, or share footage of them without consent.
• Scrape, resell or redistribute our card or pricing data. Pricing data is licensed to us and may not be passed on.
• Create multiple accounts to farm free credits, invite rewards or promotional grants.
• Reverse engineer the service, or attack, overload or probe our systems.
• Use automated tools against the app except through an interface we publish for that purpose.

We may suspend or close accounts that break these rules, and we may do it without warning where the conduct is serious.

7. Webcam play and tournaments

• Live play is for users 18 and over.
• Other players can see and hear you. Be aware of your background and who else is in the room.
• Ordinary battles are not recorded by us. Tournament feature matches may be streamed publicly and recorded. You will be told before a match is featured and you can decline.
• Tournament hosts set their own rules, entry fees and prizes. Events are run by their hosts, not by us. Disputes about a result, a prize or an entry fee are between you and the host.
• Report bad behaviour with the in app tools. We can remove users from the platform, but we cannot police everything in real time.

8. Seller and point of sale features

• You are responsible for your own tax, licensing and consumer law obligations.
• Selling through a connected marketplace also binds you to that marketplace’s terms.
• Card payments run through your own connected Stripe account. Chargebacks, refunds and payout disputes are between you, your customer and Stripe.
• Shipping labels and insurance are provided by a third party carrier service. Claims follow that carrier’s process.

9. Discord

Connecting Discord is optional and also subject to Discord’s own terms. Listing a Discord server in our directory means you confirm you are entitled to represent it.

We do not host or moderate conversation on Discord. What happens in a listed server is that server’s responsibility. We may remove a listing at any time, in particular if the server is used for anything illegal or abusive, or if our bot is removed from it.

10. Your content and your data

Your collection, inventory, decks, photographs and lists belong to you. You grant us the licence we need to store, process and display them so the service can function, including sending scan images to our identification providers and showing anything you choose to publish or share.

11. Our content

The software, design, database structure and aggregated pricing are ours or our licensors’. You get a personal, non exclusive, non transferable right to use the service. Nothing here transfers ownership.

12. Trademarks and independence

TCG Command Center is an independent tool and is not affiliated with, endorsed by or sponsored by The Pokémon Company, Nintendo, Creatures, GAME FREAK, Wizards of the Coast, Hasbro, Konami, Bandai, Disney, Lucasfilm, Riot Games, TCGplayer, PriceCharting or any other publisher or marketplace.

Card names, set names, images and logos are the property of their respective owners and are used for identification purposes only.

13. Availability

We provide the service as it is. We do not promise it will be uninterrupted, error free, or that any particular feature will keep existing. We may change, suspend or discontinue parts of it. Where a change is material and you are on a paid plan, we will give you notice.

14. Disclaimers

To the fullest extent the law allows, the service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non infringement. We do not warrant that pricing, identification or availability information is accurate or complete.

15. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or the value of cards lost, misidentified, mispriced or mishandled in a deal we were not a party to.

Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim arose, or one hundred US dollars, whichever is greater.

Some jurisdictions do not allow these limits, so parts of this section may not apply to you.

16. Indemnity

You agree to indemnify us against claims arising from your use of the service, your content, your trades and sales, or your breach of these terms.

17. Ending your account

You can close your account at any time. We may suspend or close an account that breaks these terms, creates risk for other users, or is required to be closed by law. If we close your account without cause, we will refund the unused portion of a prepaid period.

18. Changes to these terms

We may update these terms. The date at the top will change, and we will give notice of material changes by email or in the app. Continuing to use TCC after a change means you accept it.

19. Governing law

These terms are governed by the laws of the State of Ohio, United States, without regard to its conflict of law rules. Disputes will be brought in the state or federal courts located in Ohio, and you and we consent to that jurisdiction.
